Terms of Use
Everything on this site is educational material only, not advice and not an offer to trade.
Educational material, not advice
Everything here is educational material only, not advice and not an offer to buy or sell any instrument. We explain how gold (XAU/USD) is quoted and how the arithmetic works, and we describe what a broker's documents say, but we do not tell you what to do with your money.
This desk is not a broker, bank or licensed adviser, and it does not manage accounts. A decision to trade is yours, and it should be taken with a firm that is licensed to serve you and with the regulator that supervises it in mind.
Dated figures and affiliate links
Figures are dated and must be verified with the broker before you rely on them. A spread, a fee or a leverage cap can change after the date we read the documents, and the broker's current terms are the ones that bind you. Our corrections policy explains how we handle a figure that was wrong when written.
Some links on this site are affiliate links, which means we may be paid if you open an account through them. That payment does not change the text. Your relationship is with the broker, not with this desk, and any dispute about an account is between you and that firm.
The Law That Applies to These Terms
These terms are governed by the laws of Kenya. If a dispute arises about the site’s content or these terms, the courts of Kenya have jurisdiction, unless a mandatory consumer protection rule gives you the right to bring a claim elsewhere. The site is published for readers in Kenya, and references to KSh, M-Pesa, and the CMA are made in that context. The regulator caveat is specific: FxPro is licensed by the FCA (UK), CySEC and FSCA — not by the CMA of Kenya.
The site does not provide regulated financial services in Kenya and is not authorised by the CMA. Any trading you do is with FxPro under its own terms, which may be governed by a different law depending on the entity that serves you. You should read FxPro’s client agreement to understand which law applies to your account and which regulator supervises it. The site’s mention of a regulator is not a statement that the site itself is licensed or supervised by that regulator.
If any part of these terms is found to be invalid under Kenyan law, that part will be removed and the remaining terms will stay in force. The terms do not create a partnership, agency, or fiduciary relationship between you and the site. Headings are for convenience only and do not affect interpretation. Where the site links to external pages, those pages are not under the site’s control, and their terms and laws may differ from these.
Limits of Liability in Plain Words
Kakamega Gold is not liable for trading losses you incur. Trading gold on leverage carries a high risk of losing money rapidly, and the site cannot control market movements, platform availability, or your decisions. If you lose money after reading an explanation of margin or pips, that loss is yours. The site does not guarantee that any information is complete, current, or suitable for your situation, and it does not promise that examples will match live market conditions.
The site is not responsible for errors in third-party services, including FxPro’s platform, payment providers, or M-Pesa. If a deposit is delayed, a platform is down, or an order is rejected, those are matters between you and the provider concerned. The site does not execute orders and cannot reverse a trade, release a margin call, or adjust a spread. Any reliance you place on the site is at your own risk, and you should verify critical details directly with FxPro before acting.
To the extent permitted by law, the site’s liability is limited to the amount you paid to access the site, which is zero for public pages. The site does not exclude liability that cannot be excluded under applicable law, including for fraud or matters that law requires to be covered. Nothing in these terms is intended to limit your statutory rights as a consumer in Kenya. If a court finds a clause unenforceable, the rest of the terms continue to apply.
The risk is real
CFDs on gold carry a high risk of loss, and most retail accounts lose money. Leverage magnifies both directions, which is why a cap is a cap and not a setting to aim at: at the applicable cap, a 0.10-lot gold position needs about $85.50 margin, and that is a statement about margin, not about safety.
Nothing on this site is a guarantee of any outcome, and no page should be read as a promise of profit. If you cannot afford to lose the money you would put at risk, do not trade with it.
The Affiliate Relationship in Full
Kakamega Gold earns money through affiliate links. When you click a link to FxPro and open an account, the site may receive a payment from FxPro. That payment does not change what you pay to trade, and it does not give you a worse price. The link is a commercial arrangement, and it is the main way the site is funded. You are not obliged to use any link; you can go directly to FxPro if you prefer.
The affiliate relationship does not give the site access to your account, your trades, or your personal data held by FxPro. It also does not allow the site to influence FxPro’s execution, spreads, or leverage decisions. Any figure you see on the site, such as the worked example that a 0.10-lot gold position needs about $85.50 margin at the applicable cap, is illustrative and is not a quote from FxPro. Your actual margin depends on the leverage cap that applies to the FxPro entity serving Kenya.
You should assume that any outbound link to a broker may be an affiliate link. The site aims to be clear about this rather than hide it in a footer. If a page mentions M-Pesa as a funding route, that is general information about how Kenyan traders commonly fund accounts; it is not a promise that every method is available to every client. Check FxPro’s own pages for the current funding options and any conditions attached to them.
What Kakamega Gold Provides and What It Does Not
Kakamega Gold provides general information about trading gold (XAU/USD), including how contracts are sized, how margin is calculated, and how funding routes such as M-Pesa work. The site does not provide personalised investment advice, portfolio management, or a recommendation to buy or sell any instrument. Any decision you take after reading is your own, and it should be based on your circumstances, not on the fact that a page explained a formula.
The site is not a broker, dealer, or execution venue. It does not hold client money, process trades, or set spreads, commissions, or swap rates. When you trade, you do so with FxPro, which is licensed by the FCA (UK), CySEC and FSCA — not by the CMA of Kenya. The terms that govern your account, including costs and leverage, are between you and FxPro, and you should read them before funding.
The site is not a signal service, a copy-trading platform, or a place to follow someone else’s positions. It explains mechanics: one standard lot of gold is 100 oz, one pip is 0.01, and the reference price used in examples is approximately 4275.0. Those facts help you understand a trade, but they are not a forecast. Nothing here tells you when to enter or exit, and no example should be treated as a model portfolio.
How Changes to These Terms Are Published
Changes to these terms are published on this page. The site does not send individual notices for every edit, so you should check this page if you want to know the current version. The date of the latest change is shown at the top of the page. Continued use of the site after a change means you accept the updated terms. If you do not accept a change, you should stop using the site.
Material changes, such as a new affiliate relationship or a change in the law that applies, will be reflected in the relevant section rather than hidden in a general update. The site does not promise advance notice of every change, and it does not maintain an archive of past versions. For that reason, you should not rely on a saved copy of these terms as the current statement; the live page is the authoritative version.
The site may also change the examples it uses, including the reference price of approximately 4275.0 or the worked margin figure of about $85.50 for a 0.10-lot gold position. Those examples are illustrative and may be updated without notice. They do not form part of a contract with you, and they do not override FxPro’s own terms. If you need a fixed record of what you agreed to, rely on the agreement you sign with FxPro, not on this page.
What You Agree to When You Use the Site
By using Kakamega Gold, you agree to use the information for your own education and not to resell it or present it as your own advice. You agree not to misuse the site, attempt to disrupt it, or scrape it in a way that imposes an unreasonable load. You also agree that you are responsible for checking any fact before you trade on it, including the pip value, the lot size, and the margin requirement that applies to your account with FxPro.
You agree that the site does not owe you a duty of care in the way a licensed adviser would. The site explains mechanics, such as why one standard lot of gold is 100 oz and why one pip is 0.01, but it does not assess whether gold suits your risk tolerance. You should treat every example as a calculation, not a recommendation. If you are unsure, seek independent advice from someone authorised to give it in Kenya.
You agree that any dispute about the site will be handled under the law described above and that you will not hold the site responsible for decisions you take with FxPro. The site may restrict access to anyone who breaches these terms. These terms do not affect any rights you have under the FxPro client agreement, and they do not change the regulator caveat: FxPro is licensed by the FCA (UK), CySEC and FSCA — not by the CMA of Kenya.
